Servitly Console - Terms of Service

Welcome, in quality of User you are subject to this terms and conditions.

If you continue to browse and use this web application, the Console, you are agreeing to comply with and be bound by the following terms and conditions of use, which together with the Privacy Policy govern the Provider relationship with you concerning the Console. If you disagree with any part of these terms and conditions, please do not use this Console.

This policy is effective from January 1, 2020.

The use of the Console is subject to the following terms of use:

The Console is designed and must be used only to configure the DPS applications.
The Console uses cookies to verify the user identity and storing preferences.
Neither the Provider nor any third parties provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness or suitability of the information and materials found or offered in the Console for any particular purpose. The User acknowledges that such information and materials may contain inaccuracies or errors and the Provider expressly excludes liability for any such inaccuracies or errors to the fullest extent permitted by law.
The uses of any information or materials on the Console is entirely at User own risk, for which the Provider shall not be liable. It shall be User own responsibility to ensure that any products, services or information configured through the Console meet your specific requirements. Any reliance the User place on such information is therefore strictly at its own risk.
In no case the Provider shall be liable for any loss or damage including without limitation, indirect or consequential loss or damage, or any loss or damage whatsoever arising from loss of data or profits arising out of, or in connection with, the use of this Console.
In no event the Provider shall be liable for any damage on the connected Products, including without limitation, indirect or consequential damage, or any damage whatsoever arising the use of the Console.
The Console may contains material which is owned by or licensed to the Provider. This material includes, but is not limited to, the design, layout, look, appearance and graphics. Reproduction is prohibited other than in accordance with the copyright notice, which forms part of these terms and conditions.
All trademarks reproduced in the Console, which are not the property of, or licensed to the Provider, are acknowledged on the Console.
Unauthorized uses of the Console may give rise to a claim for damages.
Through the Console, Users can link to third-party applications or softwares which are not under the control of the Provider. The Provider has no control over the nature, content, and availability of those applications. The inclusion of any links does not necessarily imply a recommendation or endorse the views expressed within them.
From time to time, the Console may also include links to other third-party applications or softwares. These links are provided for User convenience to provide further information and services, and it do not signify that the Provider endorses the third-party applications or softwares. The Provider has no responsibility for the content of the linked third-party applications or softwares.
The use of the Console and any dispute arising out of such use of the Console is subject to the laws of Italy.
Every effort is made to keep the Console up and running smoothly. However, the Provider takes no responsibility for, and will not be liable for, the Console being temporarily unavailable due to planned maintenance.

Acceptable use policy

In using the Console is forbidden to publish any content which:

is libelous or maliciously false.
is obscene, indecent or blasphemous.
infringes any copyright, moral rights, database rights, trademark rights, design rights, rights in passing off, or other intellectual property rights.
infringes any rights of confidence, rights of privacy, or rights under data protection legislation.
constitutes negligent advice or contain any negligent statement.
constitutes an incitement to commit a crime.
is in contempt of any court, or breach of any court order.
is in breach of racial or religious hatred or discrimination legislation.
is in breach of official secrets legislation.
is in breach of any contractual obligation owed to any person.
is not appropriate for all persons who have access the content in question.

The user must not use the Cosnole for any purpose related to gambling, gaming, betting, lotteries, sweepstakes, prize competitions or any gambling-related activity.

It is forbidden the usage of the Console for any spamming purposes related to marketing, advertising, promotion, commercial offering or the supply and/or sale of goods and/or services.

If the user becomes aware of any published material on the Console that contravenes this policy, is pleased to notify the Provider by email (see the Contacts paragraph).
